ASCARON ONLINE USER AGREEMENT

This Agreement governs access to the Ascaron Online websites, game client, game servers, personal account, store, and related digital features.
1 Operator and scope
The service operator and party to this Agreement is Knuth Capital LLC FZ, Company No. 2531107, registered at Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, UAE. Contact: [email protected].
This Agreement applies to ascaron.online and ascaron.ru, the game client, game servers, accounts, support, the in-game store, and other features expressly identified as part of Ascaron Online. A User is an individual who visits a website, creates an account, or uses the game.
If a feature is subject to additional terms, those terms apply together with this Agreement. If they conflict, the additional terms prevail only for that feature.
2 Acceptance
The User accepts this Agreement through a separate checkbox during registration or another unambiguous action that the interface clearly identifies as acceptance. The User must be able to open and save the Agreement before accepting it.
The Privacy Policy is informational. Consent to personal data processing, when required, is obtained separately from contractual acceptance. Consent to non-essential cookies is also requested separately.
A person who does not accept these terms must not create an account or use the service.
3 Capacity and minors
The User confirms that they may enter into this Agreement under the law applicable to them. A person who has not reached the age of full legal capacity may use the service and make purchases only with the consent of a parent or legal representative where the law requires it.
The Operator may restrict paid features, request evidence of the legal representative's consent, or close an account created in breach of applicable law.
4 Account and security
During registration, the User provides a valid email address, a unique login, and a password. The User is responsible for protecting access credentials and for activity through the account, except where access resulted from a breach for which the Operator is responsible.
The User must not disclose the password, access another person's account, buy or sell accounts, register for another person without authority, create accounts to evade restrictions, or automate account creation without the Operator's permission.
If compromise is suspected, the User must change the password and contact [email protected]. The Operator never asks for a password, full payment card number, CVC or CVV, or one-time banking code.
5 Licence to use
The Operator grants the User a limited, revocable, non-exclusive, non-transferable right to install the game client and use the service for personal, non-commercial purposes while the account remains active.
The User may not copy, distribute, rent, sell, decompile, or modify the software or content except where expressly authorised by the Operator or mandatory law. This licence does not transfer ownership of the game, virtual items, or any other service element.
6 Virtual items and crystals
The service may use crystals, points, items, characters, upgrades, and other virtual elements. They are limited digital access rights within the game. They are not money, electronic currency, securities, deposits, or investments and do not earn interest or income.
Crystals and virtual items cannot be exchanged with the Operator for money, withdrawn from the service, used to pay outside the service, or redeemed, except through a refund of the original payment where the Refund Policy or mandatory law permits it.
The Operator may change future product ranges, prices, and game characteristics. A completed purchase is not changed retroactively, although game balance and content characteristics may be adjusted reasonably for security, error correction, and gameplay.
7 Paid digital products
The User may purchase crystals and other digital products displayed in the official store interface. Before payment, the interface must show the product name and quantity, price, currency, applicable fees, delivery method and expected timing, and a link to the Refund Policy.
Payment places an order for the specific digital product on the terms shown before confirmation. Banks and payment providers may apply their own terms and checks. The Operator does not store CVC or CVV and does not ask the User to send them to support.
After payment confirmation, the User receives an electronic transaction record stating the date, identifier, product description, amount, currency, applicable fees, and Operator details.
8 Product delivery
A digital product is normally credited automatically after the Operator receives successful payment confirmation. If it is not delivered, the User must contact support and provide the account identifier, date, amount, currency, and transaction number.
The Operator bears the risk of an accidental crediting error until the product is actually delivered to the account. The Operator may correct a duplicate or excessive credit after reviewing the transaction logs.
9 Refunds and payment reversals
Refunds are governed by the Refund Policy. Nothing in this Agreement limits mandatory consumer rights that cannot be excluded by contract.
The User should report a disputed transaction to support in good faith before initiating an unjustified payment dispute. The Operator may temporarily restrict the disputed balance or account during a review, but the restriction must be proportionate to the risk.
10 Transactions between users
Only exchanges supported by the game interface and involving no payment of real money are permitted. Selling, buying, exchanging, or brokering accounts, characters, crystals, game currency, items, or services for money or other consideration outside the game is prohibited.
The Operator is not a party to unauthorised transactions between users, does not guarantee their performance, and may impose in-game sanctions on participants.
11 Rules of conduct
The User must comply with the Game Rules. Fraud, exploitation of errors, interference with code or networks, unauthorised gameplay automation, malware, infrastructure attacks, harassment, threats, disclosure of another person's personal data, spam, and unlawful content are prohibited.
The Operator may moderate content and apply a warning, chat restriction, removal of improperly obtained value, temporary suspension, or account closure, taking into account severity, consequences, and repeated conduct.
12 User content
The User retains rights in messages and materials they create. By posting them in the service, the User grants the Operator a non-exclusive, royalty-free right to store, reproduce, and display that content to the extent necessary to operate and moderate the service.
The User confirms that they may post the content and that it does not infringe third-party rights or the law. The Operator may remove content where necessary to comply with law, protect users, or enforce the Game Rules.
13 Maintenance and service changes
The Operator may perform maintenance, update the client, fix errors, change servers, and discontinue individual features. Where possible, material planned interruptions will be announced in advance.
The Operator takes reasonable measures to keep the service available but does not guarantee uninterrupted or error-free operation. This does not exclude liability for failure to provide a paid product or other liability that is mandatory by law.
14 Intellectual property
Software, graphics, music, text, databases, design, trade identifiers, and other service elements are protected by applicable law or used by the Operator on a lawful basis.
Game materials may be used in reviews, streams, and non-commercial user content to an extent reasonably connected with discussion of the game, provided this does not imply official endorsement or breach separate Operator rules.
15 Suspension and termination
The User may stop using the service and request account deletion. Deletion does not cancel accrued obligations and does not require deletion of data that the Operator must or may retain by law for accounting, dispute resolution, or fraud prevention.
The Operator may restrict access immediately in response to a security threat, fraud, unlawful activity, or serious breach. In other cases, where reasonable, the User will be notified and given an opportunity to remedy the breach or appeal.
16 Limitation of liability
To the extent permitted by law, the Operator is not liable for indirect loss, lost profit, conduct of internet providers, banks, payment providers, or other users, or loss of access caused by the User sharing credentials with a third party.
These limits do not apply to liability that cannot be excluded, including liability for intent, fraud, death or personal injury, and breach of mandatory consumer rights. The Operator's aggregate liability for a specific paid transaction will not be limited below the amount of that transaction where the law prohibits such a limit.
17 Events outside reasonable control
A party is not liable for delay caused by an event beyond its reasonable control, including widespread communications failures, government action, natural disaster, war, epidemic, or a major cyberattack. The affected party must take reasonable measures to reduce the consequences.
18 Changes to the terms
The Operator may update this Agreement. Each version is published with its update date. Material changes that disadvantage the User or change the purpose of data processing will be communicated through the website, game, or email before taking effect where reasonably possible and legally required.
Where fresh consent is required by law, continued use alone does not replace that consent. Purchases already completed remain subject to the version effective at the time of purchase unless mandatory law requires otherwise.
19 Governing law and disputes
This Agreement is governed by the laws of the United Arab Emirates. This choice does not deprive a consumer of mandatory protection under the law of the country of their habitual residence where that protection applies regardless of the chosen law.
Before starting court proceedings, the User may submit a complaint to [email protected], identifying the account, claim, relevant dates, and transaction numbers. A dispute is heard by the competent court at the Operator's location unless mandatory jurisdiction rules allow the User to bring it elsewhere.
